Battle of the Parks01What you are agreeing to
In this agreement, "the Event" means Battle of the Parks, a pickleball tournament scheduled for October 2026, location to be announced, together with any practice, warm-up, check-in, or related activity. "PickleFiends LLC," also called "the Organizer," means PickleFiends LLC, together with its members, managers, captains, volunteers, scorekeepers, and helpers. "you" means the person entering.
You accept this agreement when you check the box on the entry form and submit your entry, and again each time you take the court at the Event. If you do not accept it, do not enter and do not play.
The Event is run by PickleFiends LLC, an independent organizer. It is not organized, sponsored, endorsed, or supervised by Hudson County, Bergen County, Essex County, or the government or parks department of any municipality. Entry is free.
02Who may enter
You must be 18 or older on the day you play. The Event does not accept entries from minors, and no parent or guardian may enter a minor by signing on their behalf.
You must meet the roster rule for the park you represent: you either play those courts regularly, or you live in that city or township. You represent one park for the whole Event.
You confirm you are in good enough physical condition to play competitive pickleball, that no doctor has told you not to, and that your stated rating is honest.
03Risks you are accepting
Pickleball carries real risk of injury, including serious and permanent injury, and in rare cases death. You accept those risks knowingly and voluntarily. They include, and are not limited to:
- falls, collisions, sprains, fractures, and torn muscles, ligaments, or tendons
- being struck by a ball or a paddle, by your partner or by anyone else
- court conditions: cracks, puddles, debris, uneven surfaces, nets, posts, and fencing
- outdoor conditions: heat, cold, sun, wind, rain, insects, and poor air quality
- cardiac, respiratory, or heat-related medical events brought on by exertion
- the conduct of other participants, spectators, and members of the public in a public park
- delayed or unavailable medical help, and travel to and from the courts
You are responsible for judging whether conditions are safe for you, and for stopping when they are not. Nobody at the Event is required to inspect the courts for you or to tell you to stop.
04Release of liability
You release, waive, and discharge the Organizer, and the owners and operators of any park, court, or facility used for the Event, from all claims, demands, and causes of action for injury, death, illness, or property loss arising out of your participation, to the extent those claims are based on ordinary negligence. This release applies to you, and to anyone bringing a claim through you or on your behalf.
This release does not cover gross negligence, recklessness, willful or wanton misconduct, or intentional wrongdoing, and it does not waive any right that New Jersey law does not permit you to waive. If any part of it is held unenforceable, the rest still applies.
05Your responsibility for your own conduct
You are responsible for what you do at the Event. If someone brings a claim against the Organizer because of your conduct, you agree to cover the Organizer's resulting costs, including reasonable legal fees. This does not apply to claims caused by the Organizer's own gross negligence, recklessness, or intentional wrongdoing.
06Medical care and insurance
The Event provides no medical staff, no athletic trainer, and no medical coverage of any kind. If you are hurt, you consent to first aid and emergency transport being summoned, and you are responsible for the cost.
You are responsible for carrying your own health insurance. The Organizer carries no insurance that covers your injuries.
07Photos and video
Photos and video taken at the Event may be used to promote the Event and future editions of it, on the website and on social media, without payment to you. If you do not want to appear, tell your captain or email the address below before you play, and reasonable effort will be made to keep you out of posted material. This does not apply to anything filmed or posted by other participants or by the public.
08Your equipment and belongings
Bring your own paddle and shoes and keep track of your things. Nothing is stored, watched, or insured for you, and the Organizer is not responsible for anything lost, stolen, or damaged.
09Conduct, and removal from the Event
Play by the house rules, follow all park rules and posted signs, and treat the other players and the neighbors decently. The Organizer may remove you from the Event for unsafe play, abusive behavior, misrepresenting your rating or your eligibility, or for being under the influence of alcohol or drugs. Removal ends your participation and nothing else in this agreement.
10Changes and cancellation
Dates, courts, divisions, and format may change, and the Event may be delayed, shortened, moved, or cancelled outright, including for weather, court conditions, permits, or low turnout. Entry is free, so there is nothing to refund. The Organizer is not responsible for any travel, lodging, equipment, or time off you spend getting there.
11Your information
Your entry reaches the Organizer by email and is used to build rosters, seed divisions, and contact you about the Event. It is shared with your park's captain for that purpose. It is not sold, and it is not given to anyone else without your say-so.
12Governing law and where disputes go
New Jersey law governs this agreement. Any dispute arising out of it or out of the Event goes to the state courts of New Jersey sitting in Hudson County, and you agree those courts have jurisdiction over you.
13How you accept, and the record of it
Checking the box on the entry form has the same effect as signing this page. The entry email generated by the form records the version of this agreement you accepted and the date and time you accepted it, and that email is the record.
You are confirming that you have read this agreement, that you understand you are giving up legal rights, and that nobody pressured you into it.
